What is subject-to?

Buying a house subject to the seller's existing mortgage: the loan stays in the seller's name and the buyer makes the payments.

Why it matters to an investor

A subject-to deal lets a buyer take over the seller's payments without a new loan. It can solve a seller's problem fast but carries the due-on-sale risk.

How investors use it

  • Get the loan balance and payment.
  • Run the subject-to calculator.
  • Have an attorney draft the paperwork.

Questions

What is the risk of subject-to?

The lender can call the loan due when the property is transferred.

Is subject-to legal?

It is lawful in most places, but the structure and disclosure matter. Use an attorney.
