How we collect and check county records →How unpaid tax and foreclosure work in Virginia
The county or city files a court case against property with unpaid real estate tax, and the court orders the property sold at auction. The owner can pay the tax, penalties, interest and costs at any time before the court-ordered sale; money left over after the sale goes back through the court to the former owner or lienholders.
Mortgage foreclosures: non-judicial. Most mortgages (deeds of trust) are foreclosed out of court by a trustee's sale after public notice; no court case is needed.
